My fiend is a Chinese Born. She was adopted by a Muslim family since infant and since then she has been using her adopted grandfather name as her's Binte. She is married and have children. Does her marriage valid in Islaam by using her grandfather name as her Binte?
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
The family lineage does not have any effect on the validity of the marriage contract if this woman is a Muslim and married a Muslim man. The marriage is correct if it met all the requirements, like the mutual consent, the presence of the guardian and the two witnesses, and specifying the identity of bride and the bridegroom. However, we draw the attention of the questioner that it is not permissible for this girl to be named after the family who had adopted her as the Prophet said: "If anyone makes a false claim to paternity, or being a client of other than his own masters, he is cursed by Allaah, the angels, and all the people." [Ibn Maajah] The Prophet also said: "Whoever is called after a man who is not his father knowingly paradise is forbidden for him." [Al-Bukhari and Muslim] Under any circumstances, this woman being called after this family does not affect the validity of the marriage except if the guardians of this woman are Muslims but other people conduct the marriage contract without being entrusted by them to do so, as in this case the marriage contract is invalid as her guardian is not present.
