I had an argument with my wife, so she left the house more than a month now. Is rely bothering me that she has gone. What should I do? You think that like a divorce? Because to me I feel like it. Should I take her back? What the Islaam point of view of that? She used to cover her hear, so after a while she uncovered I asked her to do so but she said that she don't feel free with the scarf on. "She is black American converter."
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
First of all you have to know that it is very rare for marital life to be problem free. So one has to be wise and take it easy when dealing with these problems and not be hasty. One has to seek the best solution in solving these problems. Allaah has mentioned the steps of treating a disobedient wife, and this is mentioned in Fatwa: 83324.
There is no doubt that your wife misbehaved by leaving the house without your permission, except if she had a valid excuse for that. Leaving home in itself is not considered as divorce, if you had not uttered the word divorce to her. Therefore, you have to take her back to your home, and she has to come back if there is no obstacle. As regards Hijab (Islamic attire for women), you have to be lenient towards her in this matter, especially since you mentioned that she is a new Muslim. You have to clarify to her the benefits and advantages of Hijab. Then, if she abides by the commandments of religion, keep her as your wife, otherwise there is no good in her; divorce her and may Allaah grant you a better wife.
Allaah knows best.
