Referring to question No. 1354, if the one who died had made a will of paying 1/3 of his money to the charity, would the percentage of interest be considered a part of the 1/3 or do we have to pay the 1/3 and the percentage of usury?
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
First of all, you should put out the percentage of usury from the wealth of the deceased. If you know the actual percentage, you pay them because it has been taken from them unjustly. If they are unknown, then you spend it in charity.
Allah Says (what means): {O you who have believed, fear Allah and give up what remains [due to you] of interest, if you should be believers.} [Quran 2:278]
After taking out the ratio of the usury, you should put out the 1/3 of his wealth, which he has determined in his bequest. We ask Allah’s blessing for you and all Muslims, and His forgiveness for this deceased and dead Muslims.
