Wants to join his family in India but his parents want him to stay abroad

Question:

I am an Indian working in a company in Russia. Though my pay package is good and I even have family status, what I am worried is that next year my children's school would start and I want them to be educated in India. The atmosphere in Russia is not conducive to staying alone. If I leave the job and go looking for the same in India, the main objection from my family including parents (except wife) is that the package would not be even half of what I get now. My question is 1) Would it amount to wrong doing as not listening to parents and 2) Would it amount to na - shukri of Rizq from Allaah Ta'ala. I feel the safety of my Eemaan and Aamaal is in staying with family if in Russia or going back to India if not able to stay with them. I hope I am clear with my question. Please advice urgently.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

 

We have said in previous Fatwa about being away from wife for a long period: "It is the right of a wife upon her husband that he should not be away from her for more than six months. Some scholars say four months. This is the rule given by the commander of the believers, 'Umar  may  Allaah  be  pleased  with  him after he knew that the woman can only endure waiting for this period and not more.

Based on this, you should not stay away from your wife for this long period without her permission and consent. If she is not pleased with your staying away from her, you should go to her or bring her to stay with you." See Fatwa: 85939 also read Fatwa: 88642.

But in your case we do not advise you to bring your wife since you are living in a non-Muslim country where evil, sins and disobedience of Allaah are widespread and certainly that affects one's faith, adversely. See Fatwa: 81642.

Your children also have great rights upon you. They need your care, love, and supervision, so you can not deprive them from their natural and religious rights. We said in a previous Fatwa "As to your children, it is your duty to take care of them, educate them, and teach them the teachings of Islam. Allaah Says (what means): {O you who believe! Ward off from yourselves and your families a Fire (Hell) whose fuel in men and stones…}[Quran 66:6].

So, if there is someone who assumes their education, then there is no objection to travel. Otherwise, it is not permissible to leave them unless there is dire need." See Fatwa: 83804.

Leaving you job and going back to your family is neither considered being ungrateful to Allaah's blessings nor is it disobedience to your parents since it is to protect your faith and fulfill the rights of your wife and children. Rather it is compulsory to go back to your family as soon as possible. For details read Fataawa: 84804 and 86982.
