Question:
Salam Alykoum and thank you for the great work you guys do at this web site. Al Hamdulliah I am married and Al Hamdulliah I pray all prayers on time. Since I am ignorant with some of figh matter I have a question. In the past my wife and I, whenever we have an argument we used prfound language because of ignorance. For example if she or I complain a lot I say"quit bitching" meaning quite complaining. Or sometime we say to each others stop being a "bitch" meaning complianing or annoying. Then Al Hamdulliah I made tawba not to say these words again because I was ignorant when I used to say them. Is my marriage still valid? I mean do these words have any effect in the validity of marraige if they were used for the sole purpose to describe a mean or lousy attitude? Thank you wa assalam alykoum
Answer:
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
These expressions have no effect on the bond of marriage and the scholars clarified the words [or expressions] which lead to divorce; among which are clear words that lead to divorce without their need to be accompanied with the intention of divorce, and metaphors of divorce that do not lead to divorce unless they are accompanied with the intention of divorce. For more benefit, please refer to Fataawa 85521 and 90531.
Finally, it should be noted that the spouses should respect each other and value the status of each other so that compassion and good marital relations would prevail between them.
Allaah Knows best.
