You may postpone ‘Umrah and accompany your wife to your country

Question:

My wife is pregnant and I want to perform umrah together with my wife and a baby girl (2 years old) and take them to home back in India. But the thing I am concerned is if I go to umrah with my wife (in April, which will be 5th month of pregnancy), I need to take leave from my job, and then I may not be able to get leave again to accompany my wife in travel to go home back in India (in June, which will be 7th month of pregnancy), and my annual vacation is in October, and I don’t want my wife to travel without a Mahram. As I do not have any other family members here in Doha, I think I may not be able to care for her properly in case of any emergency in my absence at home, as my job does not permit me to leave during office hours, and hence it is very difficult for me to keep her here without sending her back home in India where her parents as well as my parents can take care of her. So what do you suggest..? 1. Perform first Umrah, which will be first umrah of life, and if inshallah I get leave again then accompany her to India, and if I don’t get leave then send her ALONE to India WITHOUT Mahram. 2. Postpone Umrah, and then accompany my wife to home back in India.
Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

We have already clarified in Fataawa 83795 and 81210 that it is not permissible for a woman to travel without a Mahram (i.e. a husband or a person whom one is permanently prohibited from marrying due to suckling, marital, or blood relations).

What we may advise you to do is to divide your vacation, in a way that you my allocate some of it for ‘Umrah and some other for travelling with your wife to your country and by doing so, you can combine between the two matters.

If this is not possible, then you may go for ‘Umrah and when you want to travel with your wife, you should take an emergency leave even if it is an unpaid leave for two or three days, during which you may travel with your wife and then return to work. If this is also not possible, then although the ‘Umrah is obligatory according to our view here in Islamweb, and that it is an immediate obligation according to the view of the Hanbali School of jurisprudence, yet the majority of the jurists may Allaah have mercy upon them are not of the view that it is an immediate obligation. Rather, many scholars may Allaah have mercy upon them are even of the view that ‘Umrah is not obligatory, and that it is only desirable and this is one of the two narrations from Imaam Ahmad may Allaah have mercy upon him and this is the view chosen by Ibn Taymiyyah may Allaah have mercy upon him. Therefore, you may act upon the opinion of the scholars who say that it is not an immediate obligation, and you may travel with your wife and then perform ‘Umrah at another time if this is possible.
