Islamic finance companies asking for securities from their clients

Question:

Can an Islamic Investment (Finance) Company ask for securities from its clients in order to give facilities?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

 

It is permissible that investment companies ask their clients for Sharee'ah-approved securities, such as mortgage and guaranty. Scholars unanimously agree that both mortgage and guaranty are legitimate. For more details, review Fatwa 81377.

We draw your attention to the fact that it is necessary to fulfill the Sharee‘ah prerequisites for these facilities. The most important prerequisite is to avoid conditioning a usurious surplus in case of delay in payment.
